Chicago Worker Killed While Filling Potholes on I-294

FillingPothole

Roadside construction workers continue to face severe hazards in Illinois, and the latest incident has taken the life of another employee. The incident also injured two other workers, and it serves as a reminder of how little protection roadside workers get from passing motorists. If a construction accident of this nature harmed you or someone you love, consider speaking with an experienced workers’ compensation lawyer in Chicago.

No Criminal Charges Filed After SUV Driver Strikes Three Tollway Workers in Chicago

On May 30th, 2026, NBC 5 Chicago reported that a tollway worker in Chicago had lost his life after an accident on I-294. The accident also injured two other workers, and officials noted that all three employees were tollway workers conducting maintenance on the roadway. According to various accounts, they were attempting to fill potholes when an SUV approached and struck all three of them.

The crash reportedly occurred at about 4:30 AM, suggesting that darkness may have been a contributing factor. The SUV driver who allegedly struck the three workers remained at the scene and cooperated with law enforcement. Local police did not announce any criminal charges against this individual, and they did not reveal what might have caused the collision. The specific injuries of the two injured workers also remain unclear, although the Governor of Illinois asked residents to pray for them.

Why Are Roadside Workers So Vulnerable to Passing Vehicles?

Some might say that passing vehicles represent an inevitable and unavoidable hazard for roadside workers. However, these incidents are often the result of lackluster safety protocols. Adequate lighting and reflective gear are critical for these workers, especially at night. Cones, signage, and barriers also help reduce the chances of passing vehicles colliding with workers.

What Kind of Compensation Can I Get After Losing a Loved One to a Construction Accident?

A fatal construction accident should lead to considerable compensation for surviving family members. At the very least, you should receive “death benefits” after the loss of your loved one. This should cover the cost of future lost wages, any unpaid medical bills your loved one left behind after their accident, and funeral expenses.

However, you might also want to consider the possibility of a personal injury lawsuit. If your loved one was struck by a passing driver while working on a highway, you could simply sue the driver and recover additional compensation for non-economic damages. You might also receive more compensation for future lost wages and funeral costs.
