Sources say that the proposed rules have “stalled,” and there is no word on when they will be finalized. The changes would have required all employers to create their own Heat Injury and Illness Prevention Programs (HIIPs), including mandatory rests once temperatures reached a certain level.

OSHA Still Enforces Federal Heat Protections

While progress on OSHA’s new standards has stalled, the federal agency continues to enforce existing rules and regulations regarding employee safety during extreme heat. The existing rules allow OSHA to randomly inspect certain employees when temperatures rise, and this may encourage employers to protect their workers or risk fines and other penalties.

The current rules fall under the General Duty Clause, Section 5(a)(1). This extremely vague rule requires employers to protect their workers from hazards likely to cause death or serious injury. Because of the all-encompassing nature of this rule, OSHA can define extreme heat as an applicable hazard.

Inspectors who conduct random inspections during hot days will search for signs that employers are protecting their workers from this hazard. These protections might include reliable water supplies, shaded rest areas, and proper training to prevent heat stroke and other illnesses.

Does Illinois Have Its Own Heat Protections for Workers? 

Many other states have created their own rules and regulations that protect workers against extreme heat. Illinois is not one of these states, which means that employers default to OSHA guidelines. That being said, lawmakers in Illinois are currently debating whether to pass a state law called the Workplace Extreme Temperature Safety Act, which would give workers additional protections.
